Alliance Defending Freedom is a legal alliance that advocates for the right of people to freely live out their faith. Through strategic litigation, public education, and by partnering with pro-family legislators, pastors, and the like in order to enact laws which protect religious freedom.
Alliance Defending has helped establish numerous pieces of pro-religious freedom legislation across the USA, such as North Carolina’s H.B. 2 (House Bill 2), Arizona’s S.B. 1062, and Mississippi’s H.B. 1523.
Opponents have often sought to paint Alliance Defending Freedom and its attorneys as “hate group”, because of their advocacy on behalf of religious freedom, a charge which it has vehemently denied and opposed on multiple occasions.
Alliance Defending Freedom has successfully brought many cases to the United States Supreme Court, including recent cases surrounding religious liberty, such as the Masterpiece Cakeshop v. Colorado Civil Rights Commission, where the court ruled that the state of Colorado violated the rights of Jack Phillips when it sanctioned him for refusing to create a specialty cake to celebrate a same-sex wedding; “Masterpiece Cakeshop v. Colorado Civil Rights Commission” (2018).
In another case, “Bergdahl v. Obama (2016)”, which challenged President Barack Obama’s power to detain an American citizen indefinitely without access to legal counsel, Justice Samuel Alito said in his concurrence: “Nor does this case involve a new assertion of presidential authority. It is a case about the power of Congress to protect the Nation from foreign enemies, including the power to protect our fellow citizens from terrorism.”
A number of cases have been fought between Alliance Defending Freedom and “Boys Hope Girls Hope”, a group that advocates for children’s rights to live out their faith. Alliance Defending has successfully claimed that “Boys Hope Girls Hope” discriminated against their members, who were Christians seeking to live out their faith. A case was brought against “Boys Hope Girls Hopes” in Washington, D.C. on behalf of transgender students at two Christian school districts; “Alliance Defending Freedom v. United States Department of Education and United States Department of Justice” (2015).
